Terms and conditions

1. Acceptance
a. Acceptance of a Quote is deemed acceptance of these terms and conditions of Auscape International Pty Ltd (Auscape).
b. Auscape must be informed within 24 hours of any discrepancy in the order.

2. Variation of the terms
Any variation of these terms and conditions must be agreed in writing.

3. Specific use must be requested
Auscape will grant specific rights only after being notified by you of the intended use, providing this particular use is available.

4. Reproduction rights
a. After a fee has been agreed and a licensing invoice issued there is a firm and binding contract for Auscape to grant reproduction rights and you to acquire them. If, after such invoicing, you request cancellation of the reproduction rights, a cancellation fee of 50% of the invoiced amount will be payable.
b. The licensing invoice will define the reproduction rights. Any use of any image outside the rights granted will constitute an infringement of copyright.
c. If, after such invoicing, you request cancellation of the reproduction rights, a cancellation fee of 50 percent of the invoiced amount will be charged.
d. You agree to indemnify Auscape in respect of any claims or damages or any loss or costs arising in any manner from the reproduction without proper reproduction rights of any images supplied to you by us.

5. Copyright
a. Copyright of any image provided by Auscape remains with the photographer. Auscape will grant only a specific licence to use the image and not ownership of it.
b. Reproduction rights granted are to you only and may not be assigned. No image may be copied or distributed for purposes other than that specified in the licence.
